The information in this section is for Divorce Act ISO respondents - the person responding to an ISO application made under the federal Divorce Act. In other words, this information is for:
-
anyone living in Nova Scotia;
-
who is responding to an application made outside of Nova Scotia;
-
where the application is to get an order, or change an order for child support or spousal support under the Divorce Act;
-
where the other party lives outside of Nova Scotia, in another province/territory within Canada or in a reciprocating jurisdiction outside of Canada, and;
-
you were divorced from the other party in Canada AND one of the following:
-
there is an order for support made under the Divorce Act (which was finalized as part of your divorce) that the applicant wants to change, OR
-
there is not an order for support made under the Divorce Act and there is no claim for support that is outstanding under your divorce (e.g. you applied for support as part of the corollary relief but the claim has not been finalized).*
The Divorce Act ISO Application you are responding to will have either a Form A.3 or A.4. If the application you received has a Form A.1 or A.2, please see the NS ISO Guide and Information for Respondents (Responding to a NS ISO Application).
